Texas to Defy Biden Admin’s Order to Give Feds Access to Park Along Rio Grande

EAGLE PASS, Texas — As of Wednesday afternoon, Army National Guard troopers stay posted at momentary gates erected on the entrance to a city-owned park alongside the Rio Grande. The park was seized by order of Texas Governor Greg Abbott and closed off to Border Patrol brokers until their entrance into the world is first coordinated with state regulation enforcement and the Texas Military Department.

The state seems to be standing agency as a Biden administration deadline of “the end of the day” for the state to take away the gates and permit unimpeded entry to the Border Patrol approaches. General Counsel Jonathan Meyer, on behalf of the Department of Homeland Security, communicated it to Texas Attorney General Ken Paxton in a letter on January 10.

As reported by Breitbart Texas, the DHS letter to Paxton was despatched in response to the seizure of Shelby Park just a few days earlier below a Texas statute for regulation enforcement and catastrophe aid functions by Abbott in response to the border disaster impacting his state. The DHS letter to Paxton cited the statutory authority granted to Border Patrol brokers to patrol personal lands inside 25 miles of the border with out a warrant. The letter warned the state was impeding the federal brokers with the seizure of the property and the situations positioned upon the Border Patrol for entry.

In addition, the DHS letter asserts the position of the momentary gates on the entrance of the park, put in place by state authorities, is on federal land. The federal authorities acquired the land in query after an intense authorized battle with the City of Eagle Pass over the precise to erect a border fence as required by the Secure Fence Act of 2006.

Detailed within the letter despatched to Paxton by DHS Counsel was the drowning of three migrant members of the family, a mom and two minor kids, who perished within the Rio Grande waters a day after the seizure of the park. Although the letter doesn’t particularly blame the state for the drownings, the DHS basic counsel alleges the state precluded the Border Patrol from getting into the park to carry out rescue duties associated to the incident on January 12, saying, “Texas has demonstrated that even in the most exigent circumstances, it will not allow Border Patrol access to the border to conduct law enforcement and emergency response activities.”

In response to the calls for made by the Department of Homeland Security in Counsel Meyer’s demand to grant unimpeded entry to the Border Patrol, Texas Attorney General Ken Paxton responded in a letter on Wednesday. In his response to DHS, Paxton disputed the arguments made of their stop and desist letter, saying:

Texas permits immediate entry into Shelby Park by any U.S. Border Patrol personnel responding to a medical emergency, and this entry shouldn’t be “limited to use of the boat ramp,” as you say. TMD has ordered its Guardsmen not to impede lifesaving look after aliens who illegally cross the Rio Grande. To that finish, TMD has erected gates that permit for speedy admission when federal personnel talk the existence of some medical exigency.

Paxton went on to say:

President Biden has been warned in a sequence of letters, one among them hand-delivered to him in El Paso, that his sustained dereliction of obligation in securing the border is illegitimate. By instructing your company and others to ignore federal immigration legal guidelines, he has breached the assure, present in Article IV, § 4 of the U.S. Constitution, that the federal authorities “shall protect each of [the States] against Invasion.”

The battle over management of the park now finds the City of Eagle Pass, who opposes the state seizure of Shelby Park, and the federal authorities on the identical facet of the difficulty. When the Secure Fence Act was handed in 2006, the town battled with the federal authorities over the development of the border fencing, which might finally depart Shelby Park contained in the border fence and walled off from the town.

Then-President George W. Bush signed the 2006 bipartisan fence invoice after passage with the assist of 80 senators, together with then-senate and future presidents Joseph Biden and Barrack Obama. Democrat Senators Chuck Schumer and Hilary Clinton additionally supported the measure. Ultimately, the town misplaced its bid to forestall the development of a 1.8-mile, 14-foot-tall border fence was constructed.

In a bid to ease metropolis officers’ issues on the time, gates had been constructed on the park entrance with assurances that public entry wouldn’t be impeded from utilizing leisure services on the park. The federal land upon which the fence was constructed is now a part of the dispute between Abbott and the Biden administration.

The settlement remained in place, with residents being allowed entry to the park till the latest seizure of the park by state authorities. The momentary entrance gates put in by the Texas Military Department sit on the federal border fence footprint and now preclude the general public from accessing the soccer fields and baseball diamond inside the park. According to authorities from the town of Eagle Pass, the town’s public golf course, which can be inside the park’s confines, stays open to the general public.

Although tensions proceed to construct between the State of Texas and the Biden administration over the use and entry of the park by the Border Patrol, the tensions seem to be a lot much less seen on the park itself. Migrant crossings had lowered to a close to trickle within the space in contrast to December when a record-breaking 71,000 migrants crossed the Rio Grande into the Del Rio Border Patrol Sector — most selecting to cross in Eagle Pass.

According to a supply inside CBP, not licensed to converse to the media, migrant apprehensions have dropped to roughly 500 per day in Eagle Pass, down from greater than 2,000 per day in late December.

The supply instructed Breitbart Texas, “The battle is not between the law enforcement agents on the ground here, it’s between Austin and Washington, D.C., we just respond to different authorities who have much different view on border policies. Until that changes, we’re stuck in the middle.”
